Terms of Service

Welcome to Holler ("Holler," "we," "us," or "our"). By accessing or using our website at teamholler.com and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree to these Terms, do not use the Service.

1. Acceptance of Terms

By creating an account or otherwise accessing the Service, you confirm that you are at least 13 years of age (or the minimum digital age of consent in your jurisdiction, whichever is higher), that you have read and understood these Terms, and that you agree to be legally bound by them. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization.

2. Description of Service

Holler is an anonymous community platform designed for content creators to discuss brand deals, platform algorithms, income disclosures, and other creator-economy topics candidly and confidentially. The Service includes discussion boards, social account verification, income sharing features, and related tools.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation.

3. User Accounts

To access certain features you must register for an account. You agree to:

  • Provide accurate and complete information during registration.
  • Maintain the security of your password and accept responsibility for all activity under your account.
  • Notify us immediately at support@holler.community of any unauthorized use of your account.
  • Not create multiple accounts to circumvent bans or restrictions.
  • Not share your account credentials with any third party.

Your username is a randomly assigned anonymous handle. We strongly discourage including personally identifiable information in your username, bio, or posts.

4. User Content

You retain ownership of content you post ("User Content"). By submitting User Content, you grant Holler a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and improving the Service.

You represent and warrant that:

  • You own or have the necessary rights to the User Content you submit.
  • Your User Content does not violate any third-party rights, including intellectual property and privacy rights.
  • Your User Content complies with these Terms and all applicable laws.

We do not endorse any User Content and expressly disclaim liability arising from User Content posted by others. We reserve the right (but not the obligation) to remove any User Content that violates these Terms or that we find objectionable in our sole discretion.

5. Prohibited Conduct

You agree not to:

  • Post content that is unlawful, defamatory, harassing, threatening, abusive, obscene, or otherwise objectionable.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.
  • Post false, misleading, or fraudulent information, including fabricated income figures.
  • Attempt to identify or dox other anonymous users.
  • Use the Service to send unsolicited commercial messages (spam).
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Attempt to gain unauthorized access to any portion of the Service.
  • Scrape, crawl, or use automated means to access the Service without our prior written consent.
  • Use the Service for any illegal purpose or in violation of any applicable laws or regulations.
  • Upload or transmit viruses, malware, or any other malicious code.
  • Violate the privacy of other users, including sharing information that could identify anonymous members.

6. Social Account Connections

The Service allows you to connect third-party social media accounts (e.g., YouTube, TikTok, Instagram) to verify your status as a creator. By connecting a social account, you authorize Holler to access certain data from that account as described in our Privacy Policy. You may disconnect your social accounts at any time from your profile settings.

Your use of connected platforms remains subject to the terms of service and privacy policies of those platforms. Holler is not responsible for any actions taken by those platforms with respect to your account.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Holler and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Holler.

If you believe that any content on the Service infringes your copyright, please contact us at legal@holler.community with a detailed description of the alleged infringement. We will respond in accordance with the Digital Millennium Copyright Act (DMCA) and applicable law.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of your information as described therein.

9. Anonymity and Community Norms

Holler is built on the principle of anonymous discourse. You must not attempt to identify, expose, or otherwise "dox" other users. Violations of this principle may result in immediate and permanent account termination and may be reported to law enforcement where appropriate.

Income figures and deal disclosures shared on the platform are user-submitted and unverified. Holler makes no representation as to their accuracy and they should not be relied upon for financial or business decisions.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Holler does not warrant that (a) the Service will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOLLER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; OR (iv) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF ONE HUNDRED US DOLLARS (USD $100) OR THE AMOUNT YOU PAID TO HOLLER IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless Holler and its licensees, licensors, employees, contractors, agents, officers, and directors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service.

13. Termination

We may suspend or terminate your account and access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, third parties, or for any other reason.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your account at any time by contacting us or using the account deletion feature in settings.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in San Francisco County, California, and you consent to personal jurisdiction in those courts.

PLEASE READ THIS CAREFULLY: YOU AND HOLLER WAIVE THE RIGHT TO A JURY TRIAL AND AGREE THAT ANY CLAIM SHALL BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last updated" date at the top of this page and, where appropriate, notifying you via email or an in-app notification. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

16. Miscellaneous

These Terms constitute the entire agreement between you and Holler regarding the Service and supersede all prior agreements. If any provision is found to be unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision will not be considered a waiver of those rights.
